1. Agreement to Terms

By accessing or using redCacti's website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. redCacti is operated by redCacti ("we," "us," or "our").

2. Description of Service

redCacti is a SaaS platform that provides website SEO analysis, internal link optimization, broken link detection, and related web crawling services. Our Service includes:

• Automated web crawling and page analysis
• Broken link detection and reporting
• Orphan page identification
• AI-powered semantic internal link suggestions
• Content and metadata analysis
• SEO health scoring and monitoring
• Historical trend tracking
• Free sitemap audit tools

3. Account Registration and Eligibility

To access certain features of the Service, you must register for an account. You agree to:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription Plans and Billing

4.1 Plan Tiers

We offer multiple subscription tiers: Free, Pro, Agency, and Enterprise. Each plan includes different features, page limits, website limits, and manual crawl credits as described on our pricing page.

4.2 Billing and Payments

• Paid subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• Failure to pay may result in service suspension or termination
• We may change pricing with 30 days' notice to active subscribers

4.3 Credits System

Manual crawl credits reset weekly (every Monday). Credits do not roll over and unused credits expire. Automated scheduled crawls do not consume manual credits.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds or prorated amounts will be issued for partial billing periods, except as required by law.

5. Acceptable Use Policy

You agree NOT to:

• Use the Service to crawl websites you do not own or have explicit authorization to analyze
• Circumvent robots.txt, rate limits, or other technical restrictions
• Use the Service for any illegal, harmful, or fraudulent purpose
• Attempt to reverse engineer, decompile, or extract source code from our Service
• Resell, redistribute, or provide access to the Service to third parties without authorization
• Use automated tools to create fake accounts or abuse our free tier
• Overload our systems through excessive API requests or abuse
• Use the Service to transmit malware, viruses, or malicious code
• Violate any applicable laws or regulations

6. Web Crawling and Site Analysis

6.1 Crawling Practices

Our crawler operates in read-only mode and respects:

• robots.txt directives for all crawled sites
• Responsible crawling speeds to avoid impacting your website performance
• Standard web protocols and best practices
• Crawl depth and page limits based on your subscription plan

6.2 Plan Limits

Each subscription plan includes limits on websites, pages per site, and manual crawl credits. Exceeding these limits may result in incomplete crawls or the need to upgrade your plan.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, logos, and trademarks, is owned by redCacti and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our explicit written permission.

7.2 Your Content

You retain ownership of the websites and content you submit for analysis. By using our Service, you grant us a limited license to crawl, analyze, process, and store your website content solely for the purpose of providing the Service to you.

7.3 AI-Generated Suggestions

Our AI-powered internal link suggestions are generated using artificial intelligence technology to analyze your content. These suggestions are provided "as-is" and you are solely responsible for reviewing and implementing any recommendations.

8. Data Retention and Deletion

We retain crawl data, page content, and analytics for as long as your account is active. You may delete individual sites or your entire account at any time through the account settings. Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law or for legitimate business purposes (such as billing records).

9. Service Availability and Support

9.1 Service Uptime

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience unexpected downtime.

9.2 Support

Support is provided via email. Higher-tier plans may receive priority support. We do not guarantee response times for free accounts.

10. Disclaimers and Limitation of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of any crawl results, link analysis, or AI-generated suggestions. You are solely responsible for verifying and implementing any recommendations.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, redCacti SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless redCacti and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Unauthorized crawling of websites you do not own

12. Termination

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in fraudulent or abusive behavior. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including indemnification, disclaimers, and limitations of liability) will remain in effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and redCacti regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
